If you are an employer, owner, landlord or occupier of business or non-domestic premises, (commonly known as the ‘Duty Holder’ - Scotland, and ‘Responsible person’ – England) you could be legally responsible for the fire safety of your employees, customers, and anybody else who could be affected by a fire at your premises.
If you have 5 or more employed you require a written fire risk assessment (FRA).
Every responsible person must comply with ‘Fire (Scotland) Act 2005’. Failure to do so can result in prosecution.
Your responsibilities.
If you are the ‘Duty Holder’ or ‘Responsible Person’ you hold the following responsibilities.
To carry out a Fire Risk Assessment annually and review it regularly.
Communicate with staff about identified risks.
Put in place the appropriate fire safety measures.
Design an emergency plan, including evacuation routes.
Provide all staff with fire safety information and training.

It is mandatory in the UK to have a Fire Risk Assessment if:
Your business has 5 or more Employees.
Your premises are visited by members of the public.
You are a landlord of business premises or house with multiple occupancy (3 or more families).
You are self-employed with business premises.
Failure to conform can lead to serious penalties or imprisonment.
